Harvatek Files Countersuit Against Cree and Its Affiliates for Patent Infringement

Dec. 05, 2014 – Today Harvatek Corp. (“Harvatek”) announced that it has entrusted Devlin Law Firm LLC to represent it in filing a lawsuit against Cree, Inc. (“Cree”), Cree Hong Kong Limited, and Cree Shanghai Opto Development Limited for patent infringement in the United States District Court for the Northern District of California, seeking to prohibit Cree and its affiliates from infringing Harvatek's U.S. LED patents.

Harvatek was previously accused of infringing Cree's six U.S. patents on Sep. 15, 2014. Both parties had agreed to suspend the proceedings for negotiations, but the failure of these negotiations led Harvatek to file a countersuit against Cree and its affiliates.

Harvatek Statement

Harvatek declares that it respects intellectual property rights, including Cree's patent strength. However, Harvatek will vigorously defend its shareholders and clients if any patentee attempts to target Harvatek using patents.

Harvatek has long-term investments in building a strong patent portfolio. Due to the historically friendly relations between the parties, Harvatek did not intend to initiate any patent litigation lightly. Nevertheless, Harvatek will not yield to unreasonable harassment.

Future Outlook

Harvatek emphasized that sales revenue and the number of patents are not the sole indicators of patent strength. The company plans to initiate a series of actions in the near future to demonstrate its patent capabilities and its ability to compete with international leaders.
