Result of the Judgment for Defensing Trademarks Rights

Our company's name and trademarks "宏齊", "HARVATEK" and related domain names have been used without our consent for a long period of time by the China companies, 宏齊光電子(深圳)有限公司 (formerly known as Harvatek Optoelectronics (Shenzhen) Co., Ltd., now operates under the name HQG OPTOELECTRONICS (SHENZHEN) CO., LTD.) and 深圳市宏齊科技有限公司(Shenzhen Hongqi/HARVATEK Technology Co., Ltd.). Such behaviors are suspected of infringing our rights and interests in an unfair competition manner. Shenzhen Baoan District People's Court recently ruled that such behaviors were illegal and should be stopped. Such behaviors are suspected of infringing our rights and interests in an unfair competition manner. Shenzhen Baoan District People's Court recently ruled that such behaviors were illegal and should be stopped. The results of the judgment are summarized below:

  1. 宏齊光電子(深圳)有限公司 (HQG OPTOELECTRONICS (SHENZHEN) CO., LTD.) should stop using the company name containing the words "宏齊" and "HARVATEK";
  2. 宏齊光電子(深圳)有限公司 (HQG OPTOELECTRONICS (SHENZHEN) CO., LTD.) shall cease to use the domain name "harvatek.cn" (i.e., cancel the domain name "harvatek.cn");
  3. 宏齊光電子(深圳)有限公司 (HQG OPTOELECTRONICS (SHENZHEN) CO., LTD.) should stop using "@harvatek.com" as the e-mail suffix;
  4. 深圳市宏齊科技有限公司(Shenzhen Hongqi/HARVATEK Technology Co., Ltd.) should stop using the company name containing the word "宏齊"(HARVATEK).
  5. 宏齊光電子(深圳)有限公司 (HQG OPTOELECTRONICS (SHENZHEN) CO., LTD.) and深圳市宏齊科技有限公司(Shenzhen Hongqi/HARVATEK Technology Co., Ltd.) shall compensate us for the economic loss and the reasonable litigation costs; and
  6. 宏齊光電子(深圳)有限公司 (HQG OPTOELECTRONICS (SHENZHEN) CO., LTD.) and深圳市宏齊科技有限公司 (Shenzhen Hongqi/HARVATEK Technology Co., Ltd.) shall publish statements on their official websites for seven consecutive days to eliminate the impact of their unfair competition behaviors.
We would like to reiterate that we always value the respect and protection of intellectual property rights. This judgment not only proves our commitment to brand value but also firmly defends the market order and fair competition. We call on all our customers and partners to be aware of and avoid confusion with manufacturers who misuse our trademarks and company name, in order to avoid highly risky quality and after-sales service. In particular, the purchase and sale of infringing products may result in infringement of intellectual property rights, the legal liability and penalties.

We sincerely hope that this judgment will become one of the standards for the industry, guiding all enterprises to operate in accordance with the law and safeguarding the fairness and transparency of the market.
